Visually Impaired Plaintiff Sues Outdoor Apparel Company Over Website Accessibility Violations

A visually impaired individual has taken legal action against a company for failing to make its website accessible to those with disabilities. On February 4, 2026, Livingston Bennett filed a class-action complaint in the United States District Court for the Northern District of Illinois against First Lite, LLC. The lawsuit alleges that the company’s website is not compliant with the Americans with Disabilities Act (ADA), thereby denying equal access to blind and visually impaired individuals.

Livingston Bennett, who is legally blind and relies on screen-reading software to navigate websites, argues that First Lite’s website contains significant barriers that prevent him and others like him from accessing its goods and services. According to Bennett, these barriers include the lack of alternative text for images, inaccessible drop-down menus, and forms that cannot be completed without a mouse—issues that make it impossible for visually impaired users to complete transactions independently. Bennett claims this exclusion violates his rights under the ADA by denying him full participation in online commerce.

The complaint highlights that despite readily available technology solutions used by other companies to ensure web accessibility, First Lite has failed to implement these measures. This failure has forced visually impaired individuals like Bennett to rely on sighted companions or visit physical stores to make purchases, which can be burdensome due to mobility challenges. Bennett seeks a permanent injunction requiring First Lite to modify its website policies and practices so they comply with ADA standards. Additionally, he requests compensatory damages for the alleged discrimination experienced by himself and other class members.
