A visually-impaired individual has taken legal action against a well-known apparel company, accusing it of failing to make its website accessible to blind and visually-impaired consumers. The lawsuit was filed by Geovanni Bahena Figueroa on February 5, 2026, in the United States District Court for the Northern District of Illinois against The Classic T-Shirt Company, LLC. Figueroa alleges that the company’s website does not comply with the Americans with Disabilities Act (ADA), denying him and others like him full access to their online services.
According to the complaint, Figueroa is legally blind and relies on screen-reading software to navigate websites. However, he claims that The Classic T-Shirt Company’s website is not compatible with such technology, preventing him from making purchases or accessing information about products. The plaintiff attempted multiple times to purchase a Short Sleeve Crew Neck but encountered numerous barriers that rendered the site unusable for someone with his disability. These barriers included missing alt-text for images, broken links, and interactive elements without clear labels.
The lawsuit highlights the importance of web accessibility for individuals with disabilities and references guidelines established by the World Wide Web Consortium (W3C) known as WCAG 2.1. These guidelines are widely accepted as standards for making websites accessible to people with visual impairments. Despite these established standards, Figueroa argues that The Classic T-Shirt Company has failed to implement necessary changes to ensure their website is accessible.
Figueroa seeks a permanent injunction requiring The Classic T-Shirt Company to modify its website in compliance with WCAG 2.1 guidelines. He requests that an agreed-upon consultant be retained to assist in training employees on accessibility compliance and regularly test user accessibility by blind or vision-impaired persons. Additionally, he demands nominal damages, pre- and post-judgment interest, costs of litigation including attorney fees, and any other relief deemed appropriate by the court.
