The complaint was lodged in the United States District Court for the Northern District of Illinois on January 30, 2026. Anderson contends that the website’s design violates the Americans with Disabilities Act (ADA) by failing to provide equal access to its goods and services for visually impaired users.
According to the complaint, Anderson requires screen-reading software to navigate websites due to her visual impairment. However, she claims that Precious Moments’ website lacks essential accessibility features such as alternative text for images, keyboard navigation capabilities, and properly labeled forms. These deficiencies allegedly prevent visually impaired users from independently browsing and making purchases on the site. Anderson highlights that despite existing technology and guidelines like the Web Content Accessibility Guidelines (WCAG) 2.2, which are widely adopted by businesses to ensure web accessibility, Precious Moments has not implemented these standards.
The lawsuit details several specific barriers encountered by Anderson while attempting to shop for holiday ornaments on preciousmoments.com. These include inaccessible sub-menu elements requiring mouse-based interaction, identical alternative text for different product images hindering understanding of product details, and failure of keyboard focus during checkout processes. As a result of these barriers, Anderson argues that she was denied an online shopping experience equivalent to that of sighted individuals.
Anderson seeks a permanent injunction compelling Precious Moments to modify its website policies and practices to comply with ADA requirements. Additionally, she requests compensatory damages for herself and other class members who have faced similar discrimination due to the website’s inaccessibility. The lawsuit also calls for declaratory relief affirming that Precious Moments’ current website operations violate federal law.
