For instance, on September 24, 2020, OSHA issued citations for violations during inspections carried out between August 4 and September 10 of that year. Despite repeated notices and demands for payment from OSHA and later from the U.S. Department of Treasury and Department of Justice (DOJ), Power Home Exteriors has failed to settle these debts.
The complaint details four separate debts accrued by Power Home Exteriors. The first debt alone amounts to $55,650.12 as of July 17, 2025, comprising principal, interest at a rate of 1%, penalties at a rate of 6%, and administrative fees. Similar calculations are presented for three other debts totaling $20,350.29, $14,643.99, and $604.46 respectively.
In response to non-payment despite multiple demands dating back to January 2021 for some debts, the DOJ stepped in on September 13, 2023. They issued another demand for payment after receiving referrals from Treasury about these outstanding obligations.
The plaintiff argues that Power Home Exteriors’ failure to pay these fines not only violates federal regulations but also represents a neglectful disregard for workplace safety standards enforced by OSHA under various sections including but not limited to CFR regulations like 29 CFR 1903.19(d)(1).
