Plaintiffs Allege Pool Manufacturer Sold Defective Pools Leading to Child Drownings

A class action lawsuit has been filed against a prominent pool manufacturer, alleging the company knowingly sold dangerously defective above-ground pools that pose a drowning hazard to children. The complaint was lodged by Katrina Hill and Lisa Weeks on October 17, 2025, in the United States District Court for the Northern District of California against Bestway (USA) Inc.

The plaintiffs, representing themselves and others similarly affected, claim that Bestway’s above-ground pools were sold with a design flaw that creates an accessible foothold for children, leading to multiple tragic incidents. The pools in question were subject to a recall due to this defect, which has reportedly resulted in at least nine child fatalities between 2007 and 2022. Despite being aware of these dangers, Bestway allegedly continued to market these pools as safe for families. “The safety of our customers is a top priority,” states Bestway’s marketing material, yet the plaintiffs argue this commitment was not upheld.

Hill and Weeks assert that Bestway’s recall efforts are insufficient and delayed. They criticize the company’s proposed remedy—a repair kit involving a rope replacement for the compression strap—as inadequate and potentially compromising the pool’s structural integrity. Furthermore, they allege that Bestway failed to provide adequate warnings or offer monetary compensation to affected consumers. This lack of effective recall measures leaves many families at risk, they argue.

The plaintiffs seek various forms of relief from the court: damages for those who purchased the defective pools, punitive damages against Bestway for its alleged misconduct, and injunctive relief requiring more effective recall actions. They demand a comprehensive notice program about the defect, corrective advertising campaigns, safe product replacements or full refunds for consumers.
