Plaintiffs accuse Data Platform Operators of Violating Privacy Rights

In a dramatic legal move, a group of plaintiffs has launched a class action lawsuit against two companies accused of violating privacy rights by misusing personal information. On September 30, 2025, Randall Miller and five other plaintiffs filed the complaint in the Circuit Court for DuPage County, Illinois, targeting BatchService LLC and Equimine Inc., which operates under the name Propstream. The case was later removed to the United States District Court for the Northern District of Illinois on November 3, 2025.

The plaintiffs allege that BatchService LLC and Equimine Inc. operate an online platform that unlawfully accesses and uses property owners’ identifying information without consent. This alleged misuse is said to breach statutory rights of publicity as protected under state laws in Illinois, California, Indiana, and Alabama. According to the complaint, these platforms have used individuals’ identities to market paid subscriptions for their services without permission. “The platform contains over 2.45 million Illinois residents’ information alone,” claims the complaint, suggesting similar figures could be applicable for other states involved.

Seeking justice not only for themselves but also on behalf of thousands of similarly affected individuals across four states, the plaintiffs demand significant legal remedies. They are pursuing statutory damages per violation as outlined by respective state laws—$1,000 in Illinois and Indiana, $750 in California, and $5,000 in Alabama—as well as punitive damages and attorney’s fees. Additionally, they seek injunctive relief to prevent further unauthorized use of personal data by these companies.

The plaintiffs aim to represent four distinct classes: one each from Illinois, California, Indiana, and Alabama. Each class includes current or former residents whose identities were allegedly exploited without their knowledge or consent to promote Defendants’ services. With allegations suggesting that each class comprises thousands of individuals—potentially surpassing five million dollars in controversy—the case meets the jurisdictional requirements under the Class Action Fairness Act (CAFA).

Representing Equimine Inc., attorneys from Baker Botts L.L.P., including Rachael Lamkin and Matthew Baker among others based in San Francisco and Dallas offices respectively, have filed a notice of removal asserting federal jurisdiction due to diversity between parties and the scale of potential damages involved. The presiding judge has yet to be named in this high-stakes legal battle identified as Case No: 25-13474.
