Carmen Clark has filed a lawsuit against her former employer, 3600 Condominium Association, alleging misclassification and unpaid wages. The complaint was lodged in the United States District Court for the Northern District of Illinois on January 23, 2026. Clark accuses the condominium association of violating several labor laws by failing to pay her earned wages and misclassifying her employment status.

According to the lawsuit, Carmen Clark was employed as an administrative assistant/keyholder by 3600 Condominium Association from July 17, 2025, until November 5, 2025. During this period, she claims that she was improperly classified as an independent contractor instead of an employee. This misclassification allegedly allowed the defendant to evade paying her due wages and benefits under federal and state labor laws. Clark asserts that despite working a fixed schedule set by the defendant and performing integral tasks for their business operations, she did not receive compensation for all hours worked. “Defendant treated Plaintiff as an employee,” states the complaint, yet they failed to provide regular paychecks or a final paycheck upon her constructive discharge.

The plaintiff alleges violations of the Fair Labor Standards Act (FLSA), Illinois Minimum Wage Law (IMWL), and Illinois Wage Payment and Collection Act (IWPCA). She claims that despite repeatedly notifying her employer about missing payments totaling over $3,000 from October to November 2025, no resolution was provided. Instead, Clark contends that her complaints led to retaliatory actions by the defendant, further exacerbating her financial predicament.

Clark is seeking various forms of relief from the court including back pay with interest, compensatory damages for emotional distress, liquidated damages for willful violations of labor laws, punitive damages for retaliation under FLSA provisions along with reasonable attorney fees and costs incurred during litigation proceedings.
