Plaintiff alleges Naked Whey misled consumers about heavy metal content in protein powders

Vince India has filed a class action lawsuit against Naked Whey, Inc., alleging deceptive business practices in the marketing and sale of their protein powder products. The complaint was lodged on November 12, 2025, in the United States District Court for the Northern District of Illinois. India accuses Naked Whey of selling protein powders that contain or risk containing significant levels of heavy metals, specifically lead, while falsely advertising them as free from such harmful substances.

The lawsuit centers around Naked Whey’s “Naked Mass Vegan Gainer” products, which are marketed as premium protein supplements with claims of being GMO-free, soy-free, gluten-free, and devoid of artificial ingredients. However, according to the complaint, these products were found to contain dangerous levels of lead based on independent testing by Consumer Reports. This report revealed that the vanilla-flavored product contained an average of 7.70 micrograms of lead per serving—significantly above safe consumption levels as recommended by health authorities.

India asserts that Naked Whey knew about the presence or risk of heavy metals in their products but failed to disclose this information to consumers. Instead, they allegedly misled customers through marketing claims emphasizing purity and transparency. The plaintiff argues that reasonable consumers would not have purchased or paid a premium price for these products had they been aware of the potential health risks associated with regular consumption due to lead exposure.

In seeking redress from the court, India is pursuing certification for a class action comprising all affected consumers in Illinois who purchased the implicated products. The lawsuit demands restitution and disgorgement of profits obtained through these alleged deceptive practices. Additionally, it seeks injunctive relief to prevent Naked Whey from continuing such advertising tactics without full disclosure about product safety concerning heavy metal content.

Representing Vince India are attorneys Gary M. Klinger and William J. Edelman from Milberg PLLC’s Chicago office and Alexander E. Wolf from their Beverly Hills office. The case is identified under Case No: 1:25-cv-13878 and will be presided over by judges yet to be assigned.
