In a compelling legal battle that could impact numerous employees, a former warehouse associate has taken legal action against a major corporation for alleged violations of labor laws. Kassandra Dominguez filed a collective action complaint on November 25, 2025, in the United States District Court for the Northern District of Illinois, Eastern Division, accusing Abbott Laboratories of failing to pay proper overtime wages as mandated by the Fair Labor Standards Act (FLSA).
The lawsuit brought forth by Dominguez claims that Abbott Laboratories did not correctly calculate overtime compensation by excluding non-discretionary bonuses and other forms of remuneration from their regular rate calculations. This oversight allegedly resulted in thousands of hourly employees being underpaid for overtime work over the past three years. According to the complaint, Dominguez worked at Abbott from April 11, 2021, to June 3, 2025, with her most recent base hourly rate being $24.40. However, she argues that additional payments such as “Award Pay” were not factored into her overtime pay calculations.
Dominguez asserts that this practice violates Section 7(a) of the FLSA, which requires employers to compensate non-exempt employees at one and a half times their regular rate for hours worked beyond forty per week. She highlights an example from her pay stub dated November 11-17, 2024, where she worked over forty hours but was compensated without including Award Pay in her overtime calculation. The complaint further alleges that Abbott’s centralized payroll system perpetuated these violations across all its locations nationwide.
The plaintiff seeks various forms of relief from the court: designation of the case as a collective action under FLSA provisions; full back pay with liquidated damages; pre- and post-judgment interest; coverage of legal fees and costs; and any other appropriate remedies deemed just by the court. Dominguez also requests an order requiring Abbott to provide contact information for all affected employees so they can be notified about joining this collective action.

Turner from Sommers Schwartz P.C., Dominguez aims to hold Abbott accountable for what she describes as willful neglect in compensating its workforce fairly according to federal law standards.
