A visually-impaired individual has taken legal action against a major apparel company, accusing it of failing to make its website accessible to those with disabilities. On February 6, 2026, Geovanni Bahena Figueroa filed a class-action complaint in the United States District Court for the Northern District of Illinois against Wacoal America, Inc. The lawsuit claims that the company’s website does not comply with the Americans with Disabilities Act (ADA), thereby denying blind and visually-impaired individuals equal access to its online services.
Geovanni Bahena Figueroa, who is legally blind and relies on screen-reading software to navigate websites, argues that Wacoal America’s website, www.cw-x.com, is not fully accessible. According to the complaint, this lack of accessibility violates Title III of the ADA by preventing visually-impaired users from enjoying the same online shopping experience as sighted individuals. The plaintiff attempted multiple times to purchase Muscle Support Compression apparel from the site but was hindered by various access barriers such as missing alt-text and broken links. These obstacles have caused frustration and denied him full use of the website’s offerings.
The lawsuit highlights that approximately 8.1 million people in the United States are visually impaired, including 2 million who are blind. It emphasizes that accessible websites are crucial for providing equal opportunities for these individuals. The plaintiff contends that Wacoal America has failed to implement necessary modifications to its website despite being aware of these issues. The suit seeks a permanent injunction requiring Wacoal America to bring its website into compliance with Web Content Accessibility Guidelines (WCAG) 2.1 and ensure ongoing accessibility through regular testing and policy changes.
Figueroa’s legal team argues that without court intervention, he and others will continue facing discrimination when attempting to access Wacoal America’s online services. The complaint calls for declaratory relief and an order certifying a nationwide class of similarly affected individuals under Federal Rule of Civil Procedure 23(a) and (b). Additionally, it seeks nominal damages, attorney fees, costs associated with bringing forth this action, pre- and post-judgment interest, as well as any other relief deemed appropriate by the court.
