A visually-impaired woman has filed a class-action lawsuit against a fitness company, accusing it of violating the Americans with Disabilities Act (ADA) by failing to make its website accessible to blind and visually-impaired individuals. The complaint was lodged by Constance Henry in the United States District Court for the Northern District of Illinois on November 12, 2025, targeting Body Firm Aerobics, LLC.

The plaintiff, Constance Henry, who is legally blind and requires screen-reading software to access digital content, alleges that Body Firm Aerobics’ website, Vasafitness.com, contains significant barriers that prevent her and others like her from independently accessing the site. According to the complaint, these barriers include missing alternative text for images, inadequate heading structures, and navigation issues that require mouse use—a method inaccessible to many visually-impaired users. Henry argues that these deficiencies deny her equal access to goods and services offered by Body Firm Aerobics both online and at their physical locations.

Henry’s lawsuit highlights the broader issue of web accessibility in an increasingly digital world. She points out that despite existing technology and guidelines for making websites accessible—such as those provided by the World Wide Web Consortium (W3C)—Body Firm Aerobics has failed to implement necessary changes. This oversight not only excludes blind users from participating in online commerce but also violates federal law under Title III of the ADA. The complaint seeks a permanent injunction requiring Body Firm Aerobics to modify its website policies and practices to ensure compliance with accessibility standards.

In addition to injunctive relief, Henry is seeking compensatory damages for herself and other class members who have faced discrimination due to these accessibility barriers. The lawsuit also calls for punitive damages and requests certification as a class action on behalf of all similarly affected individuals across the United States.
