Former Employee Alleges Elevate Healthcare Network Violated Wage Laws

Juan Lopez Nino has filed a class-action lawsuit against Elevate Care, Inc. and its affiliated entities in the United States District Court for the Northern District of Illinois on November 17, 2025. The complaint accuses Elevate Care of failing to pay minimum and overtime wages to hourly employees who were required to complete mandatory training modules off-the-clock over the past three years.

Nino, who worked as a dietary aide at Elevate Care Chicago North from March 6, 2025, through September 14, 2025, alleges that he and other hourly employees were compelled to undertake mandatory training without compensation. This practice allegedly violated the Fair Labor Standards Act (FLSA), the Illinois Minimum Wage Law (IMWL), and the Illinois Wage Payment and Collection Act (IWPCA). The lawsuit claims that these trainings were essential for job performance and imposed by Elevate Care across all its facilities in Illinois. Nino contends that this policy was uniformly enforced regardless of position or location within the company.

The complaint outlines four counts against Elevate Care: Count I is a collective action under the FLSA for unpaid overtime wages; Count II is a class action under IMWL for failure to pay state minimum wages; Count III is another class action under IMWL for failure to pay state overtime wages; and Count IV is a class action under IWPCA for failure to pay all earned wages owed, including mandatory training time. The plaintiff seeks unpaid wages, liquidated damages, statutory penalties, pre- and post-judgment interest, attorneys’ fees, costs, and any other relief deemed appropriate by the court.
