Former Employee Alleges Discrimination by Veterinary Service Provider Under ADA

A former employee has filed a lawsuit against her previous employer, alleging discrimination and retaliation under the Americans with Disabilities Act (ADA). On February 2, 2026, Dayna Judd initiated legal proceedings in the United States District Court for the Northern District of Illinois against NVA Services Inc., claiming that the company failed to accommodate her disabilities and retaliated against her after she sought reasonable adjustments.

Dayna Judd, who worked as a receptionist for NVA Services Inc. from October 25, 2021, until her termination on October 23, 2025, alleges that she was subjected to discrimination due to her physical and mental impairments. These include anxiety, depression, and bilateral knee pain. Judd claims these conditions were exacerbated by medication side effects such as drowsiness and delayed alertness. Despite being able to perform her job duties with or without accommodations, Judd states that after disclosing her disabilities and requesting necessary adjustments at work, she faced increased scrutiny and disciplinary actions.

The complaint details a series of events beginning in May 2025 when Judd transferred to the Animal Care Center of Downers Grove upon promise of a pay increase. Following this transfer, she experienced what she describes as unwarranted disciplinary write-ups for issues like “drooping eyes” and drowsiness—symptoms related to her medical condition. Although Judd provided medical documentation supporting her need for accommodations such as flexible arrival times and additional breaks, she contends that NVA Services Inc. ignored these requests and continued issuing disciplinary actions inconsistent with company policy.

Judd further asserts that the company did not apply its own attendance grace period policies fairly compared to other employees outside of her protected class. Her attempts to address these concerns internally were met with more disciplinary measures rather than constructive dialogue or resolution. The situation culminated in her termination on October 23, 2025—an action which Judd argues was directly linked to both her disability-related needs and complaints about discriminatory treatment.

In response to these allegations, Judd is seeking various forms of relief from the court including back pay, compensatory damages for emotional distress and loss of employment benefits, punitive damages for willful violations of the ADA by NVA Services Inc., along with attorney fees and costs associated with bringing this action forward.
