Former delivery driver alleges Great American Delivery Service of sex discrimination and retaliation

A recently filed federal lawsuit describes allegations that a courier company subjected a female employee to sex-based discrimination, harassment, and retaliatory termination after she reported inappropriate conduct in the workplace. The complaint was filed by Stephanie Captain on March 27, 2026, in the United States District Court for the Northern District of Illinois against Great American Delivery Service, Inc.

According to court documents, Captain worked as a delivery driver for the defendant from approximately September 22, 2025 until her termination on or about October 17, 2025. She claims that during her employment she met or exceeded performance expectations but was treated differently than employees outside her protected class because of her sex. The complaint states that “Defendant has subjected Plaintiff to different terms and conditions of employment than others not within her protected class and has subjected Plaintiff to a hostile work environment on the basis of sex, violating Title VII.”

The filing outlines several incidents involving a dispatcher named Moe who allegedly began with friendly behavior but became increasingly intrusive. On October 8, 2025, Moe is said to have called Captain from a recorded work phone asking if she had a boyfriend and later texted her on her personal phone without permission. The next day during a phone call witnessed by Captain’s friend, Moe allegedly stated: “I’m not going to lie. I’m interested in you.” When Captain declined his advances, Moe reportedly replied: “I don’t want anything like that, I just want to have a sexual relationship with you, nothing more, and I’ll make sure you get a ton of calls.” Captain says she refused these propositions.

The complaint further alleges that after confronting Moe about his behavior—especially following similar complaints from another female employee—Moe denied responsibility and became threatening. Captain reports that he told her she should “watch her back,” leading her to feel unsafe at work. She claims she reported these events to her supervisor Charles but received no support; instead Charles defended Moe’s actions and did not allow Captain access to human resources.

Captain states that she escalated the matter by contacting Asif, the company owner. Although Asif initially indicated he wanted to terminate Moe’s employment over the incident, he ultimately took no action after discussions with Charles according to the complaint. Despite repeated requests for an HR meeting and providing documentation including a police report filed on October 17, 2025 (in which police advised that Moe had a prior record), Captain alleges she was denied any opportunity for resolution.

Following these events and continued lack of response from management or HR—including being cut off from communication and work assignments—Captain asserts she was unlawfully terminated due to both her sex and for reporting what she believed were violations of workplace rights under Title VII.

The legal filing brings three counts against Great American Delivery Service: violation of Title VII for sex-based discrimination; violation of Title VII for sex-based harassment; and violation of Title VII for retaliation against protected activity. In each count Captain claims loss of employment benefits as well as mental anguish resulting from what she describes as willful disregard for her rights.

Captain seeks remedies including back pay with interest; front pay; compensation for lost benefits; compensatory and punitive damages; reasonable attorneys’ fees; pre-judgment interest where applicable; as well as any additional relief deemed appropriate by the court. She has requested a jury trial on all issues raised in the case.
