Credit Reporting Agency Accused by Client Richard Moore Over Data Breach

A major data breach has rocked a prominent credit reporting agency, exposing sensitive personal information of millions of individuals. Richard Moore filed a class action complaint against TransUnion, LLC in the United States District Court for the Northern District of Illinois on January 13, 2026. The lawsuit alleges that TransUnion failed to adequately protect private information, leading to unauthorized access and exposure of sensitive data.

The complaint details how the data breach, which was publicly disclosed by TransUnion in August 2025, compromised personally identifiable information (PII) such as names, Social Security numbers, dates of birth, and addresses. The breach reportedly began on July 28, 2025, but was not discovered until two days later. Despite being aware of the breach for nearly a month, TransUnion delayed public disclosure until August 26, 2025. Moore accuses TransUnion of negligence in failing to secure this sensitive information and argues that the company had numerous statutory and regulatory obligations to protect it.

Moore’s legal action is grounded in several claims including negligence, negligence per se under Section 5 of the Federal Trade Commission Act (FTCA), unjust enrichment, and breach of implied contract. He asserts that TransUnion’s failure to implement reasonable security measures resulted in significant harm to affected individuals who now face an increased risk of identity theft. The plaintiff is seeking actual and punitive damages along with injunctive relief aimed at preventing future breaches.

In addition to financial compensation for damages incurred due to identity theft risks and loss of privacy control over their PII, Moore seeks restitution for all those impacted by the breach. The complaint highlights that despite offering credit monitoring services post-breach acknowledgment, TransUnion’s actions were insufficient given their responsibility as custodians of highly sensitive consumer data.
